Respected Sir,

It has been brought into the notice of this union that some officials of NSH, Mumbai-400099 have been awarded recovery from their salary vide above cited memo number. The above cited memo No. states that the article under question was booked at Kadugodi Extention SO on 11.03.2015 for delivery in Ratnagiri which has been reported as lost in NSH, Mumbai in Set/3 on 13.03.2015 at 21.25.52 hrs.

Further it would also like to know whether any negligence on the part of officials which caused the loss of article was established by Superintendent, NSH, Mumbai before imposing of recovery vide above cited memo number. If no such enquiry was held then the said order of recovery is in violation of Rule-106 of P & T Manual Vol. III which states that “recovery to pecuniary losses caused to the government by negligence or breach of any orders by a government servant can be imposed only when it is established that the government servant was responsible for a particular act or acts of negligence or breach of orders or rules and that such negligence and breach caused the loss”.
This union therefore requests you to personally intervene in the case and cause issue orders for stoppage of recovery considering the extenuating circumstances in which the duties were performed by the officials named in above mentioned recovery memo.
Kindly acknowledge the receipt of this communication.

Regards,

          Yours faithfully
